    Unemployment

    The unemployment compensations statutes were designed to relieve the hardships caused by involuntary unemployment, but how is an applicant’s eligibility determined?  Will a forced resignation render an employee ineligible for benefits?  This presentation is designed to give human resource personnel an overview of the unemployment compensation system, the application process, hearing and appeals, as well as discussing the typical issues which may render an employee ineligible for benefits.  The presentation will address concerns frequently encountered by the employee, as presented by Attorney Andrea Niesen, and the employer, as presented by Attorney Greg Griffiths.

    Andrea B. Niesen is a civil litigation attorney with particular interest in the areas of personal injury, medical malpractice, employment law, and Wisconsin workers’ compensation.  Ms. Niesen is admitted to practice in both the Minnesota and Wisconsin state and federal court systems.

    Prior to joining the firm, Ms. Niesen practiced law in Milwaukee, Wisconsin, where she focused on personal injury, products liability, medical malpractice, employment law, workers’ compensation, lemon law, contracts, and insurance bad faith.  Ms. Niesen also has experience prosecuting cases with the domestic violence unit of the Milwaukee County District Attorney’s Office.

    Ms. Niesen received her Bachelor of Science degree from the University of Wisconsin-Stout in 2000 and her Juris Doctorate from Marquette University Law School in 2003. While earning her law degree, Ms. Niesen was a chair of the International Maritime Law Moot Court team which arbitrated cases in Brisbane, Australia.

    Ms. Niesen is a member of the Minnesota State Bar Association, Wisconsin State Bar Association, Minnesota Trial Lawyers Association, Wisconsin Academy of Trial Lawyers, and Phi Alpha Delta.  Ms. Niesen is also an active volunteer with Legal Assistance of Olmsted County and Make A Wish Foundation of Minnesota.

    Gregory J. Griffiths

    Greg represents businesses of all sizes, as well as non-profit corporations and local government entities on employment and labor law matters.

    He has extensive experience with employment and labor law in both the private and public sector. Greg advises his clients in all aspects of employment law including hiring issues, compliance with state and federal law, employment contracts and severance agreements, discipline and discharge issues, and on the prevention of employment law claims. He routinely represents his clients in the litigation of employment claims in state and federal court, as well as in administrative agency actions including the Equal Employment Opportunity Commission, the Minnesota Department of Human Rights, the Department of Labor, and the National Labor Relations Board.

    Outside the courtroom, Greg is involved with labor union contract negotiations and arbitrations and provides training to his clients on a variety of employment and human resource issues. Greg is also regularly called on by other attorneys to mediate employment related disputes and is a frequent speaker on a wide variety of employment and labor law issues.
    In addition to his legal work, Greg has served on boards of directors for numerous non-profit and charitable organizations, and is active in the Rochester Area Chamber of Commerce.

    Mr. Griffiths was appointed Dunlap & Seeger, P.A.'s managing partner January of 2010.
